As the House of
Representatives'
Republican leaders prepare
to embark on a series of
nationwide hearings that
could determine the fate
of the Senate
"comprehensive"
immigration reform bill,
President Bush is
indicating a new
willingness to negotiate
with House Republicans in
an effort to revise the
stalled legislation before
the November elections.
Republicans both inside
and outside the White
House say Mr. Bush, who
has long insisted on
comprehensive reform, is
now open to a so-called
enforcement-first approach
that would put new border
security programs in place
before creating a guest
worker program or path to
citizenship for people
living in the United
States illegally.
"He thinks that this
notion that you can have
triggers is something we
should take a close look
at, and we are," said
Candi Wolff, the White
House director of
legislative affairs,
referring to the idea that
guest worker and
citizenship programs would
be triggered when specific
border security goals had
been met, a process that
could take two years.
When the House
Republicans pushed through
a tough immigration
enforcement bill, they
were lambasted by the
Democrats, some GOP
senators and the news
media. They were condemned
as being meanspirited and
criticized for wishing to
criminalize illegal alien
workers. Senator Hillary
Rodham Clinton (D-NY) told
a crowd of immigrants that
the House Republicans are
attempting to create a
"police state."
Not only are the House
Republicans in favor of
enforcement-first, several
Democrats are calling for
the government to first
stop the flood of illegal
aliens before considering
other measures such as
guest worker programs and
pathways to citizenship.
Political analysts
believe the President's
almost sudden change of
heart is based on the
groundswell of criticism
of his "amnesty" plan by
American citizens.
Thousands upon thousands
of e-mails, telephone
calls and letters continue
to flood the White House
and the offices of key GOP
members calling for real
action on the US borders.
In May the Senate
passed immigration
legislation that appeared
weak on border security,
but would create a program
permitting illegal
immigrants who had resided
in the United States for
five years or more to
"earn" their citizenship
after paying a fine and
back taxes, learning
English and holding a job
for six years.
But conservatives began
digging deeper into the
bill and discovered a
grab-bag full of goodies
-- social security, wage
regulations, etc. -- for
people viewed by many as
lawbreakers. The Senate
bill also would allow
illegal immigrants who
have resided in the United
States from two to five
years to apply for a guest
worker program.
President Bush strongly
supported the Senate's
"comprehensive" approach
to immigration reform.
Many conservative
Republicans, especially
those in the House, said
the Senate's approach
amounted to "amnesty" and
vociferously oppose any
legalization program
before border security has
been strengthened.
Then when the Senate
"amnesty" bill arrived in
the hands of the House
leadership, Speaker of the
House Dennis Hastert
proposed that GOP
congessmen would hold
citizen hearings all
across the country in
order to get citizens'
input.
Many senators at first
complained that the
House's call for hearings
was their way of stopping
the immigration bill, but
now they seem more
receptive to the House
enforcement bill as does
President Bush.
Speaker of the House,
Denny Hastert says that
the "top thing needed is
to secure the borders and
we need to have the law
enforcement to go along
with that.
Immigration is the most
important issue for the
Republicans and
conservatives, a House
Republican aide said, and
will drive conservatives
to the polls -- unlike the
recent Senate debate on
gay marriage or the
upcoming vote on an
amendment to ban flag
burning.
As evidence, House
Republicans point to the
victory by Rep. Brian
Bilbray in a special
election in California
earlier this month.
Bilbray ran against the
approach favored by
President Bush and the
Senate and argued that the
borders must be secured
first. His opponent lost
the election partly
because she was recorded
telling illegal aliens
they didn't need "papers"
to vote.

Successful Start on a Security Fence
Chris Simcox has kept his promise and
volunteers have begun building the
Minuteman Border Fence. The successful
groundbreaking was held in Arizona on
Memorial Day weekend, as President Bush
refused to immediately deploy National
Guard and reserve troops to secure
America's out-of-control southern border
with Mexico.

Chris Simcox, president of the Minuteman Civil Defense Corps, issued the following statement on the passage today of an illegal alien amnesty bill by the U.S. Senate: "The vote to give amnesty to millions of illegal aliens by the United States Senate today, should it pass into law, would ensure that the status quo is maintained: the borders would remain wide open and the attractive nuisance of endless welfare and social programs at the expense of the American taxpayer would remain. Those climbing over the backs of those waiting patiently to abide by our laws; and instead breaking the law, illegally entering this country, and committing document fraud; those not paying taxes; and those hiring illegally would be granted full amnesty. American citizens would, of course, still be subject to prosecution for document fraud and tax evasion. This sends the message that if you play by the rules, you suffer; if you enter the United States illegally, you are not subject to the rule of law.

Illegals granted Social Security

The Senate voted yesterday to
allow illegal aliens to collect Social Security benefits
based on past illegal employment -- even if the job was
obtained through forged or stolen documents.
"There was a felony
they were committing, and now they can't be prosecuted.
That sounds like amnesty to me," said Sen. John Ensign, the
Nevada Republican who offered the amendment yesterday to
strip out those provisions of the immigration reform bill.
"It just boggles the mind how people could be against this
amendment."
The Ensign amendment was defeated on a 50-49 vote.
"We all know that millions of undocumented immigrants
pay Social Security and Medicare taxes for years and
sometimes decades while they work to contribute to our
economy," said Sen. John McCain, Arizona Republican.
"The Ensign amendment would undermine the work of these
people by preventing lawfully present immigrant workers
from claiming Social Security benefits that they earned
before they were authorized to work in our community," he
said. "If this amendment were enacted, the nest egg that
these immigrants have worked hard for would be taken from
them and their families."
Mr. Ensign was among 44 Republicans and five Democrats
who voted to block such payouts.
"It makes no sense to reward millions of illegal
immigrants for criminal behavior while our Social Security
system is already in crisis," said Sen. Jim DeMint, South
Carolina Republican. "Why in the world would we endorse
this criminal activity with federal benefits? The Senate
missed a big opportunity to improve this bill, and I doubt
American seniors will be pleased with the result."
Sen. Patrick J. Leahy, Vermont Democrat, said it would
be unfair to deny illegals the benefits.
"We should not steal their funds or empty their Social
Security accounts," he said. "That is not fair. It does not
reward their hard work or their financial contributions. It
violates the trust that underlies the Social Security Trust
Fund."
Within hours, the vote had become an issue in this
fall's elections, raised by a Republican challenger to Sen.
Debbie Stabenow, Michigan Democrat.
"Instead of protecting the retirement security of
Americans who are earning an honest living and abiding by
the laws of our country, Debbie Stabenow sided with people
who are here illegally and abuse our Social Security
system," Oakland County, Mich., Sheriff Michael Bouchard
said in a press release. "Allowing illegal immigrants to
use their illegal work history as credit towards receiving
Social Security benefits shows that Debbie Stabenow has
forgotten who she is supposed to be working for in the U.S.
Senate."
The Senate also yesterday approved an amendment to
adopt English as the nation's official language, while
reversing course from the day before on protections for
U.S. workers who will face new competition from unskilled
immigrant labor under the Senate bill. In addition,
senators voted last night to kill an amendment that would
have specified that the guest-worker program will not
provide visas that would provide a path to citizenship.

(a) Activities prohibited
It is unlawful for any person or entity knowingly -
(1) to forge, counterfeit, alter, or falsely make any document
for the purpose of satisfying a requirement of this chapter or to
obtain a benefit under this chapter,
(2) to use, attempt to use, possess, obtain, accept, or receive
or to provide any forged, counterfeit, altered, or falsely made
document in order to satisfy any requirement of this chapter or
to obtain a benefit under this chapter,
(3) to use or attempt to use or to provide or attempt to
provide any document lawfully issued to or with respect to a
person other than the possessor (including a deceased individual)
for the purpose of satisfying a requirement of this chapter or
obtaining a benefit under this chapter,
(4) to accept or receive or to provide any document lawfully
issued to or with respect to a person other than the possessor
(including a deceased individual) for the purpose of complying
with section 1324a(b) of this title or obtaining a benefit under
this chapter, ...
(5) to prepare, file, or assist another in preparing or filing,
any application for benefits under this chapter, or any document
required under this chapter, or any document submitted in
connection with such application or document, with knowledge or
in reckless disregard of the fact that such application or
document was falsely made or, in whole or in part, does not
relate to the person on whose behalf it was or is being
submitted, or ...
(b) Exception
This section does not prohibit any lawfully authorized
investigative, protective, or intelligence activity of a law
enforcement agency of the United States, a State, or a subdivision
of a State, or of an intelligence agency of the United States, or
any activity authorized under chapter 224 of title 18.
(c) Construction
Nothing in this section shall be construed to diminish or qualify
any of the penalties available for activities prohibited by this
section but proscribed as well in title 18.....
.
(C) Issuance of orders
If the administrative law judge determines, upon the
preponderance of the evidence received, that a person or entity
has violated subsection (a) of this section, the administrative
law judge shall state his findings of fact and issue and cause
to be served on such person or entity an order described in
paragraph (3).
(3) Cease and desist order with civil money penalty
With respect to a violation of subsection (a) of this section,
the order under this subsection shall require the person or
entity to cease and desist from such violations and to pay a
civil penalty in an amount of -
(A) not less than $250 and not more than $2,000 for each
document that is the subject of a violation under subsection
(a) of this section, or
(B) in the case of a person or entity previously subject to
an order under this paragraph, not less than $2,000 and not
more than $5,000 for each document that is the subject of a
violation under subsection (a) of this section.
In applying this subsection in the case of a person or entity
composed of distinct, physically separate subdivisions each of
which provides separately for the hiring, recruiting, or
referring for employment, without reference to the practices of,
and not under the control of or common control with, another
subdivision, each such subdivision shall be considered a separate
person or entity. ....
(6) Enforcement of orders
If a person or entity fails to comply with a final order issued
under this section against the person or entity, the Attorney
General shall file a suit to seek compliance with the order in
any appropriate district court of the United States. In any such
suit, the validity and appropriateness of the final order shall
not be subject to review. ....
(e) Criminal penalties for failure to disclose role as document
preparer
(1) Whoever, in any matter within the jurisdiction of the
Service, knowingly and willfully fails to disclose, conceals, or
covers up the fact that they have, on behalf of any person and for
a fee or other remuneration, prepared or assisted in preparing an
application which was falsely made (as defined in subsection (f) of
this section) for immigration benefits, shall be fined in
accordance with title 18, imprisoned for not more than 5 years, or
both, and prohibited from preparing or assisting in preparing,
whether or not for a fee or other remuneration, any other such
application.
(2) Whoever, having been convicted of a violation of paragraph
(1), knowingly and willfully prepares or assists in preparing an
application for immigration benefits pursuant to this chapter, or
the regulations promulgated thereunder, whether or not for a fee or
other remuneration and regardless of whether in any matter within
the jurisdiction of the Service, shall be fined in accordance with
title 18, imprisoned for not more than 15 years, or both, and
prohibited from preparing or assisting in preparing any other such
application.
(f) Falsely make
For purposes of this section, the term ''falsely make'' means to
prepare or provide an application or document, with knowledge or in
reckless disregard of the fact that the application or document
contains a false, fictitious, or fraudulent statement or material
representation, or has no basis in law or fact, or otherwise fails
to state a fact which is material to the purpose for which it was
submitted.

Refugee Advocacy Coalition, a radical group that has joined with
the Open Society Institute to help organize the recent protests

Most
Officials Do Not Want Boycott, except Democrat

Governor
Arnold Schwarzenegger said a
boycott would "hurt everyone," while Democratic state
senators passed a resolution supporting walkouts.
Los Angeles Mayor Antonio
Villaraigosa urged students to stay in school and
advised protesters against waving flags of their
native countries.

"You should wave the American flag,"
he said. "It's the flag of the country that we all are
proud of and want to be a part of. Don't disrespect
the traditions of this country."
Activists in Florida said many
immigrants were concerned about recent federal raids,
in which hundreds of immigrants with criminal
backgrounds were rounded up in Florida and throughout
the Midwest.
"We're not officially coordinating a
work stoppage. We are leaving it up to every
individual. We don't want people to lose a job, but we
want to encourage people to stand up for their
rights," said Maria Rodriguez, head of the Florida
Immigrant Coalition.
Opponents of illegal immigration
spent the weekend building a fence to symbolize their
support of a secure border. About 200 volunteers
organized by the Minuteman Civil Defense Corps of
California worked on a 6-foot barbed-wire fence along
a quarter-mile stretch of rugged terrain near the
U.S.-Mexico border about 50 miles east of San Diego.
The U.S. Conference of Catholic
Bishops urged immigrants to attend Mass instead of
boycotting, and suggested that churches toll their
bells in memory of immigrants who died trying to come
to the U.S. They also urged students to stay in
school.
Denver-area contractor Chuck Saxton,
who hires temporary workers, is sympathetic to the
movement.
"I'm going to go to support them.
These guys come here, they work hard and they're
honest," he said. "They provide a vibrancy to our
economy and our country that is fading."

Calif Senate Endorses Illegal Immigration Boycott
The California State Senate has endorsed Monday's nationwide boycott by illegal immigrants - a move strike organizers claim will shut down major American cities from
coast to coast, including Los Angeles.
Voting along party lines, the Democratic Senate majority approved a resolution that calls the walk-out by the nation's illegals: "The Great American Boycott of 2006."
The Golden State legislators said the action will teach Americans a lesson about what they insist is the tremendous contribution illegal immigrants make to the
U.S. economy and culture. "It's one day ... for [illegal] immigrants to tell the country peacefully, 'We matter ... (we're) not invisible,'" said Senate
Majority Leader Gloria Romero, in quotes picked up by the Associated Press.
Democrat Sen. Gil Cedillo compared the plight of illegal aliens to slaves, to women before they got the vote and to Japanese-Americans who were imprisoned by President
Roosevelt during World War II. "America wouldn't have been created without illegal action," said fellow Democrat Richard Alarcon. "They dumped a bunch of tea in
Boston harbor, illegally. God bless them," he said. Senate Republicans, however, were less sanguine about the boycott. "It is a
disingenuous effort to put the government of California on record supporting open borders," said Sen. Bill Morrow. Editor's Note: It is inconceivable to the average American voter, that elected American senators could or would support an illegal invasion by a foreign country,
determined to take over the United States. They should by law, be impeached and removed from office. Would they do it for the Communist Chinese? How about the communist Chavez of
Venezuela or Communist Cuba? They also represent foreign Hispanic countries that want to destroy America. Mr. and Mrs. America, you had better think long and hard before you vote in the
mid-term elections.

The planned boycott of American businesses on Monday by groups who support rights for illegal aliens has gained a new ally: the
California Senate. In a mind-boggling move, the legislative body passed a resolution which supports the Great American Boycott 2006. In other words, the California
Senate is siding with illegal aliens and against the overwhelming will of the American people.As noted by the
Associated Press, Californias state senators on Thursday endorsed Mondays boycott
of schools, jobs and stores by illegal immigrants and their allies
The California Senate vote was along party lines,
24-13, but it really makes you wonder what these people, even though they are Democrats, are thinking. This is America, right? The Monday boycott is by ILLEGAL aliens
and their supporters, right? Whats going on here? As noted in the news story, the resolution describes the boycott as a way to
educate the country about the tremendous contribution immigrants make on a daily basis to our society and economy. There are several things dreadfully wrong with
this picture. First, we are talking about illegal aliens people who broke the law to get into the country, and in cases where they are using false Social Security
cards and other forged documents, they are still breaking the law. Second, the whole definition of immigrant has been distorted.
Immigrants are those who have left their country of origin not only to live in America, but also to be American. Thats the key. An
immigrant wants to be an American to adopt our culture, to adopt our language, to share in the vast opportunities and responsibilities that go with being an
American. Many of these people we have seen protesting are not immigrants at all. They have no desire to be an American. They wave their own countrys flag and
demand rights, while never embracing what it means to be an American. And now, the California Senate has played right into their
hands. How pathetic. As the story notes, Opponents said the nonbinding resolution was misleading because it failed to mention a goal of the boycott was pressuring
Congress to legalize millions of undocumented people. How true. Rewarding illegal behavior is the goal. When America granted
amnesty in 1986, it only caused more illegal activity. We have no will to enforce our immigration laws; we pour millions of dollars into taxpayer-funded benefits for
illegal aliens; and now we are supposed to grant citizenship to those who have no desire to embrace the American way? Its time
to bring some common sense and political backbone into this equation. We cannot reward illegal activity. If someone wants to be a true guestworker temporarily work
in America and then return to his/her home country then in the context of immigration reform, Im sure that can be addressed. But the program cannot be a path to
citizenship. If we need more legal immigrants (in the true sense of the word), then we need to look at reforming our existing
immigration limits and guidelines. But we cant take people who are guestworkers and make them citizens simply because we didnt have the will over the last 20 years
to enforce our immigration laws. If we just grant amnesty again, we will end up right back where we started in another 20 years.
Legislative bodies, whether they are controlled by Democrats or Republicans, should have more sense than to embrace this boycott. It is
an anti-American demonstration by groups who favor rights without responsibilities and those who value cheap labor over whats best for America. That is simply wrong. _____________________________________________________________

As the details of the Senates immigration reform bill slowly begin to emerge, its no wonder why Majority Leader Bill Frist is pushing for a quick vote this week. Yesterdays
Washington Times reported on one provision that is so unpopular it couldnt even pass in Ted Kennedys home state of Massachusetts, but it is now part of a bill under consideration by the
Republican Senate. Specifically, this provision would make illegal immigrants eligible for in-state college tuition rates a benefit not afforded to American kids, whose families would no
doubt bear the costs of subsidizing illegal students at the reduced rates. Senator Jeff Sessions of Alabama noted, This means that while American citizens from Tennessee, Georgia, South
Carolina, Massachusetts have to pay out-of-state tuition rates if they send their kids to the University of Virginia or the University of Alabama, people who have illegally immigrated into the
country do not. How much sense does that make, to have people here illegally and they have more benefits than those who are here legally?
Amazingly, it seems some political elites are willing to risk alienating the conservative base in their efforts to pander to ethnic voting blocs. A former chairman of the Republican National
Committee wrote the following statement in a weekend editorial, The Republican Party cannot become an anti-immigration party. Our majority already rests too heavily on white voters
But the
way to grow a majority is not to insult taxpayers of all races who dont think illegality should be rewarded.

There's just one problem with that strategy - not everyone got the message, as you can
see. When illegal alien teenagers ditch school for a week, shut down major freeways, and hoist the Mexican flag at their school, people notice. And, they get angry! "Los Angeles talk show host Tammy Bruce reported that protesters burned
American flags and waved placards of the North American continent with America crossed out." -- Michelle Malkin Where was the Border Patrol during these marches? The Immigration and Customs Enforcement agents?
The same place they'll be if the Bush guest worker amnesty passes - ordered to stand down, watching from the sidelines, unable to help. Americans are fed up with people who crash the borders, then show up demanding better treatment
than our fellow citizens. If there's one common element among these street protests, it's the arrogance and the condescension of the marchers that is turning off Americans who see the reality
behind the happy open-borders rhetoric. FAIR and the immigration reform movement face a critical

Senate Judiciary Committee Resumes Consideration of
Amnesty Guest Worker Legislation (Wed. March 8)
Wednesday morning the Senate Judiciary Committee resumed
consideration of Chairman Arlen Specter's proposal to
establish an unlimited guest worker amnesty program. This is
a brief summary of the day's events. Further updates will be
forthcoming to keep you as up-to-date as possible.
Committee Action this Morning (Wed. March 8)
The procedure being employed for consideration of the
Specter bill is to take up the proposal title-by-title,
section-by-section until they have been through the 300-plus
page bill. Today, the committee considered Titles I and II of
the bill, which contain the border security and interior
enforcement provisions.
FAIR Exclusive: Blow-by-blow of Today's Committee Markup
As often happens during these kinds of sessions, committee
members came and went during the proceedings as other
commitments required, often leaving the committee without a
quorum (too few members present to allow votes on
amendments). Often amendments were set aside for this reason
with the expectation they will be voted on later.
Below is a list of the actions took place in
the Judiciary Committee Wednesday morning:
- Sen. Feinstein (D-CA) offered an amendment to
increase the number of border patrol agents.
- The amendment was set aside.
- Sen. Brownback (R-KS) (for Sen. Sessions (R-AL))
offered an amendment to allow limited information
sharing between the Social Security Administration (SSA)
and DHS
- The amendment was set aside.
- Sen. Kyl (R-AZ) offered an amendment to
authorizing DHS to provide transportation and officers
needed to take custody of illegal aliens caught by
local law enforcement.
- The amendment was approved by voice vote.
- Sen. Cornyn (R-TX) offered an amendment to
authorize DHS to reimburse state and local law
enforcement agencies for training and equipment needed
to carry out cooperative law enforcement agreements
under INA § 287(g) .
- The amendment passed by voice vote.
- Sen. Durbin (D-IL) offered an amendment to strike
provision criminalizing illegal immigration.
- After discussion and confusion as to the
scope of the language, the amendment was set
aside.
- Sen. Cornyn offered an amendment to make it easier
for the State Department to deny visas to nationals
from countries refusing to accept return of deported
nationals.
- The amendment passed by voice vote.
- Sen. Leahy (D-VT) offered an amendment to make
discretionary rather than mandatory a requirement that
the State Department coordinate with other countries
on border security issues.
- After discussion and disagreement, the
amendment was set aside.
- Sen. Brownback offered an amendment to reauthorize
the J-1 visa program for foreign doctors.
- The amendment was set aside.
- Sen. Brownback amendment to remove nurses from the
annual employment-based and country caps.
- The amendment was set aside.
Committee Action this Afternoon
This afternoon's session was late getting started, once
again due to the failure of enough Senators to show up. Some
of those who didn't show up are believed to be fearful of the
votes they will be asked to cast, mostly because your calls
are making a big difference.
Below is a list of actions that took place in the
Judiciary Committee Wednesday afternoon:
- Sen. Coburn (R-OK) offered an amendment to mandate
use of expedited removal for illegal aliens (other
than Mexicans) captured within 100 miles of the
southern border and within 14 days of entry.
- After disagreement over the mandatory
requirement for expedited removal, the
amendment was set aside.
- Sen. Kyl offered an amendment to build fencing in
urban areas in Arizona.
- The amendment was set aside.
- Sen. Sessions offered an amendment to the Kyl
amendment to construct approximately 700 miles of
fencing along the U.S.-Mexico border.
- After disagreeing over the effectiveness of
building a fence or whether to first study the
issue, the amendment was withdrawn for possible
separate consideration later.
- Sen. Cornyn offered an amendment to prevent
convicted felons from sponsoring immigrants.
- The amendment was set aside.
Remember, the Committee is scheduled to continue mark-up
of the the Specter proposal tomorrow (Thursday) and next
Wednesday and Thursday before the Saint Patrick's Day recess.
